Terms of Service

These Terms are an agreement between you and Firefly Flips LLC ("eMoney", "we", "us") for use of the eMoney Creators app and website (the "Service"). By creating an account you agree to these Terms and our Privacy Policy.

Eligibility

You must be at least 18, able to form a binding contract, and not barred from receiving payments under applicable law.

Your account

Keep your login secure and your information accurate. You are responsible for activity on your account. One account per person.

How campaigns work

• eMoney posts campaigns with a brief, rules, pay rate, payout caps and a budget.
• Clipping campaigns: we provide ready-made videos. You post them on your own accounts as instructed.
• UGC campaigns: you create original videos following the brief.
• You submit links to your posts. We verify each post is on an account you connected and track its performance through the platform's official tools.
• Campaigns can end, pause or change at any time, including when the budget runs out. Posts submitted after a campaign ends may not earn.

Earnings and payouts

• Earnings are based on the campaign's pay terms and verified views or other metrics reported by the platform. Platform data can be delayed or corrected, and we use the numbers the platform reports.
• Earnings are pending until our team approves the post. We may reject or reduce earnings for posts that break campaign rules or these Terms.
• Payouts are sent to your chosen payout method on our posted schedule once you reach any minimum. You are responsible for providing accurate payout details.
• We may withhold or reverse earnings tied to fraud, fake or purchased views, bots, deleted posts, or rule violations, including after payment.

Independent contractor and taxes

You are an independent contractor, not an employee, partner or agent of eMoney. You are responsible for your own taxes. We may require a W-9 or similar form and may issue tax forms such as a 1099 as required by law.

Your content

• You keep ownership of original content you create.
• You grant eMoney a worldwide, royalty-free, non-exclusive license to use, copy, edit and share content you submit for a campaign, including in eMoney's own marketing and paid ads, for as long as the campaign terms allow, unless the campaign states otherwise.
• Ready-made videos we provide remain eMoney's property. You get a limited license to post them only for the campaign and only as instructed.
• You confirm you have the rights to everything in your content, including music, images and anyone who appears in it.

Disclosure

You must follow the FTC Endorsement Guides and each platform's rules for paid content. That means clearly disclosing that you are paid by eMoney, for example with #ad or the platform's paid partnership label, whenever a campaign requires it or the law does.

Rules

You may not:

• Buy views, likes or followers, use bots, view farms or engagement groups, or inflate metrics in any way.
• Submit posts that are not on your own connected accounts, or the same post more than once.
• Post content that is illegal, hateful, harassing, sexually explicit, misleading, or that infringes others' rights.
• Make income or results claims about eMoney that are false or not allowed by the campaign.
• Break the terms of Instagram, Facebook, TikTok or YouTube.
• Reverse engineer, scrape or misuse the Service.

Connected accounts

You can connect and disconnect social accounts at any time. When you connect YouTube you also agree to the YouTube Terms of Service (https://www.youtube.com/t/terms). Each platform's terms apply to your use of that platform. We are not responsible for changes or outages on those platforms.

Termination

You can delete your account at any time. We may suspend or end your account for violations of these Terms, fraud, or risk to the Service. Approved earnings not tied to violations will still be paid.

Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee any amount of earnings, views or campaign availability.

Limitation of liability

To the fullest extent allowed by law, eMoney is not liable for indirect, incidental, special or consequential damages, and our total liability for any claim is limited to the amount we paid you in the 3 months before the claim.

Indemnity

You agree to cover eMoney's losses and costs from claims caused by your content, your breach of these Terms, or your violation of law or third party rights.

App stores

If you downloaded the app from the Apple App Store, these Terms are between you and eMoney, not Apple. Apple is not responsible for the app or its support, and Apple and its subsidiaries are third party beneficiaries of these Terms with the right to enforce them. The same applies to Google for apps downloaded from Google Play, to the extent required by Google.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Disputes will be handled in the state or federal courts located in California.

Changes

We may update these Terms. If changes are material we will notify you in the app or by email. Continuing to use the Service means you accept the updated Terms.
